Terms of Use

Effective date: February 16, 2026

1. Definitions

• "Agreement" - These terms and conditions.
• "Provider" - Incredevo, the copyright owner and operator of TheSalezMaster.
• "TheSalezMaster" - The AI-powered B2B sales intelligence and automation platform developed by Incredevo, including the web application at app.thesalezmaster.com, APIs, models, algorithms, documentation, and related intellectual property.
• "Service(s)" - All features, tools, and functionalities provided through TheSalezMaster, including contact data discovery, company intelligence, AI-generated sales outreach, and related automation capabilities.
• "Contact Data" - Business contact information such as names, email addresses, phone numbers, job titles, and company details made available through the Services.
• "User" / "You" - Any individual or entity accessing or using TheSalezMaster under a valid subscription.

2. Grant of License

Subject to this Agreement and pre-payment of applicable subscription fees, Incredevo grants you a limited, non-exclusive, non-transferable, revocable license to access and use TheSalezMaster, provided you comply with the conditions below.

This license is not royalty-free. Continued use of TheSalezMaster requires a valid, active subscription from Incredevo.

3. Subscription & Fees

• Use of TheSalezMaster requires the purchase of a subscription plan from Incredevo.
• Subscription fees must be paid in full before the start of the billing period.
• Each subscription plan includes a defined number of daily contact unlock credits (quotas). Unused credits do not roll over.
• Subscriptions are time-bound (monthly or annual) unless otherwise agreed in writing.
• Failure to pay renewal fees before the expiration date will result in automatic suspension of access.
• Incredevo reserves the right to modify pricing with reasonable advance notice.

4. Restrictions

You may not:

• Copy, modify, create derivative works of, sublicense, distribute, or resell TheSalezMaster or any data obtained through it.
• Reverse engineer, decompile, disassemble, or attempt to extract source code, models, or algorithms.
• Circumvent subscription controls, API rate limits, daily unlock quotas, or security mechanisms.
• Use automated tools, scrapers, or bots to extract data from TheSalezMaster beyond the provided API.
• Resell, redistribute, or sublicense Contact Data obtained through the Services.
• Use TheSalezMaster in violation of applicable laws, regulations, or third-party rights.

5. Acceptable Use & Anti-Spam Policy

TheSalezMaster is designed for legitimate B2B sales prospecting. Users acknowledge and agree that:

• TheSalezMaster must not be used as a mass mailing or bulk email tool.
• All outreach conducted using data or tools from TheSalezMaster must comply with applicable anti-spam laws, including CAN-SPAM (US), GDPR (EU), CASL (Canada), and other relevant regulations.
• Users must include valid unsubscribe mechanisms in all commercial email communications.
• Users must not send unsolicited communications to individuals who have opted out or expressed objection.
• Users are solely responsible for ensuring their outreach campaigns comply with all applicable laws and regulations.
• Incredevo reserves the right to suspend or terminate accounts engaging in spam, abusive outreach, or activities that damage the reputation of the platform.

6. API Usage & Quotas

• API access is governed by the rate limits and daily unlock quotas defined in your subscription plan.
• Exceeding API rate limits may result in temporary throttling or suspension of API access.
• Attempting to circumvent quotas through multiple accounts, automated scripts, or other means is a violation of this Agreement.
• Incredevo may adjust API limits with reasonable notice to maintain platform stability and fairness.

7. Contact Data Freshness & Accuracy

TheSalezMaster aggregates business contact information from multiple third-party data providers and publicly available sources. Users acknowledge that:

• Contact Data is provided on an "as available" basis and may not always be current, complete, or accurate.
• Email addresses, phone numbers, and job titles may become outdated as individuals change roles or companies.
• Incredevo does not guarantee the deliverability of email addresses or the accuracy of phone numbers.
• Users should verify Contact Data independently before relying on it for critical business decisions.
• Incredevo continuously works to improve data quality but makes no warranty regarding the completeness or freshness of any specific record.

8. Use of AI-Generated Outputs

TheSalezMaster includes AI-driven functionalities designed to assist with sales prospecting, email generation, and outreach optimization. Users acknowledge that:

• AI outputs (including generated emails, company summaries, and lead recommendations) are probabilistic and may not always be accurate or appropriate.
• Users retain full responsibility for reviewing, editing, and approving all AI-generated content before sending or acting upon it.
• TheSalezMaster is a support tool, not a substitute for human judgment in sales decisions.
• Any outreach campaign executed by the user -- including email, phone, or social media outreach -- is the sole responsibility of the user.
• Incredevo is not liable for consequences arising from the use of AI-generated content.

9. Data Retention & Deletion

• Account data and usage history are retained for the duration of your active subscription plus a reasonable period afterward for legal and operational purposes.
• Unlocked Contact Data associated with your account is retained for the duration of your subscription.
• Upon account termination or deletion request, Incredevo will delete your personal data within 30 days, except where retention is required by law.
• You may request deletion of your account and associated data at any time by contacting support@thesalezmaster.com.
• Aggregated, anonymized usage data may be retained indefinitely for analytics and product improvement.

10. Confidentiality

Users agree to maintain the confidentiality of TheSalezMaster's proprietary models, algorithms, code, and documentation.

No part of TheSalezMaster may be disclosed to third parties without Incredevo's written consent.

11. Trademarks

This Agreement does not grant permission to use the trademarks, logos, or branding of TheSalezMaster or Incredevo, except with explicit written consent from Incredevo.

12. Disclaimer of Warranty

TheSalezMaster is provided on an "AS IS" and "AS AVAILABLE" basis. Incredevo and its contributors disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. Incredevo does not warrant that the Services will be uninterrupted, error-free, or that Contact Data will be accurate or complete.

13. Limitation of Liability

In no event shall Incredevo or its contributors be liable for damages arising out of the use or inability to use TheSalezMaster, including but not limited to lost revenue, sales opportunities, business interruption, reputational harm, or damages resulting from inaccurate Contact Data or AI-generated content.

14. Indemnification

You agree to indemnify, defend, and hold harmless Incredevo, its officers, employees, and contributors from any claims, damages, liabilities, or expenses (including legal fees) arising from:

• Your misuse of TheSalezMaster or Contact Data obtained through it.
• Your reliance on AI-generated outputs.
• Outreach campaigns conducted using the Services that violate anti-spam or data protection laws.
• Any violation of this Agreement or applicable law.

15. Termination

This Agreement automatically terminates if:

• You fail to pay required subscription fees before or during the billing period.
• You breach any term of this Agreement, including restrictions on use and the anti-spam policy.
• You engage in activities that damage the platform, its reputation, or other users.

Upon termination, you must immediately cease using TheSalezMaster. Access to unlocked Contact Data and saved content will be revoked.

16. Governing Law & Jurisdiction

This Agreement shall be governed by and construed under the laws of Poland. Any disputes shall be resolved exclusively in the courts of Warsaw.

17. Acceptance of Liability or Support

Any warranties, support contracts, or service-level guarantees beyond this Agreement must be provided in a separate written agreement with Incredevo.
